Rule 119
Acts relating to the execution of contracts
(1) In connection with the implementation of the purchase agreement, the following tasks shall be performed as necessary during the administration of the contract:-
(a) If necessary, hold a meeting (post bid conference) with the relevant suppliers, consultants, service providers or construction professionals after signing the purchase agreement,
(b) Prepare work plan and schedule related to contract implementation,
(c) Arrange for the opening of the copy letter within the time according to the terms of the contract,
(d) Forming a contract implementation team if necessary,
(e) Monitoring the progress of implementation of the purchase agreement and inspecting and testing the quality aspect according to the contract administration action plan, handing over the construction site to the construction business and arranging access to the site, modification of the purchase agreement, variation order, price adjustment, suspension of the purchase agreement or Finally, verifying the completion of work, managing payments etc.,
(f) If any dispute arises between the local body and the supplier, consultant, service provider or construction business, to adopt the dispute resolution procedures mentioned in the contract, in case of violation of the contract, to take action according to the provisions related to the remedy mentioned in the contract,
(G) Managing the financial aspect of contract implementation, including the aspect of budget and cost accounting. (h) To keep the documents related to the implementation of the contract in a consistent and orderly manner,
(i) To approve edited works,
(j) To submit periodical reports on the implementation of the agreement to a higher authority.
(2) Notwithstanding anything written elsewhere in this rule, the local authority or other body supervising the execution of the purchase agreement shall not adversely affect the rights of the supplier, consultant, service provider or builder mentioned in the purchase agreement, whether the purchase agreement has been executed in accordance with the plans, specifications and terms of the purchase agreement. (3) The role of the local body in implementing the purchase agreement will be as follows:-
(a) Position of site and access arrangements (b) Moving electricity, telephone lines, water pipelines etc. in the work place,
(c) Rehabilitation,
(d) Appointment of designated officer/engineer and information to the contractor (e) Timely granting of the approval sought by the designated officer/engineer (f) Timely payment to contractors,
(f) To make other suitable arrangements.
(4) The local body shall appoint one officer to work for the execution of contracts related to construction work or supply of goods or other services. If the manpower to do such work is not available in the local body or is unable or unwilling to do so, the services of a consultant may be taken by following the procedure in accordance with this regulation:-
(a) Providing the necessary drawings and designs to the contractor (b) issuing commencement orders,
(c) delegate authority to an engineer representing you on site, monitor progress,
(d) conducting quality assurance tests,
(e) Recommending payment after examining the completed work,
(f) Preparing monthly progress and sending it to local bodies,
(g) conducting tripartite meetings,
(h) Correspondence with the contractor,
(i) Interpreting the terms of the contract,
(j) To recommend for approval of extensions and variations,
(k) To certify that the work has been completed.
